Solicitors for Business Disputes

We have successfully handled numerous business disputes for our clients. Here are some of the kinds of cases we deal with. We believe in success and your success is our success.

Solicitors for Conveyancing and Construction 

Advised a client in relation to three connected Commercial Court cases. The cases related to converting a debt into a security interest over a c. €100m hotel redevelopment. There were ancillary injunction proceedings. The case involved successfully defending an action by a bank seeking to enforce a priorities agreement.

Defence of a c. €1.8 million Commercial Court dispute in respect of a contract variation clause in a development contract. Acted for one of Ireland’s leading building companies. Of course, we settled the matter successfully for our clients.

Setting aside of planning enforcement notices and successful defence of proceedings brought by a Local Authority in Wicklow. In short, the case involved the proposed demolition of a house and removal of a sewage recycling plant.

High Court action for retail landlord in Limerick against tenant in relation to breach of covenant for non-payment of rent of c. €500,000.

Acted for a Plaintiff in Commercial Court dispute over ownership of a shopping centre. The case involved breach of pre-emption rights under the Companies Acts and issues of discovery before the Supreme Court. Value of dispute c. €11.5 million. However, the matter settled to the satisfaction of client.

Product Liability Solicitors

Successfully acted for a client in a c.€2.3M claim for damages and breach of contract in the High Court. Dispute with a leasing company who had trucks manufactured for our client. The trucks were to be leased to it for use in its logistics business, however, the trucks had latent defects.

Settled a significant case, involving negligent misrepresentation, tort and product liability. Our client was a food company and the action was against an International company in respect of defective freezer equipment. The defects caused loss to our client’s business and ultimately resulted in a receiver being appointed. We successfully secured the receiver’s consent to take the action. Our client received a waiver from the receiver in respect of the proceeds of the action. 

Financial Services Law

We were victorious for a client and agreed a pre-trial settlement in a Commercial Court case. The case involved multi-jurisdictional proceedings taken in Ireland, the UK, the Isle of Man and Jersey in respect of a receivership. However, it also involved the sale of c. Stg£47M of our clients assets. In addition, it involved a complex dispute in relation to a hedge fund product. In conclusion, we saved our client c. £8M in relation to sums due to a bank.

We acted in a successful injunction action on behalf of directors representing an investor against an Irish public listed company. An Inspector was ultimately appointed to investigate the company and the allegations made by our clients. 

We have been involved in multiple actions taken for investors in relation to the mis-selling investment funds with lending institutions. The typical size of claim was c. €100,000 – c. €5,000,000.

Healthcare Solicitors

We acted for a client in a successful in a pre-trial settlement of a dispute with a lending institution. To clarify, the case related to ownership of multiple defendants’ shares in multi-million euro healthcare business. In conclusion, the matter was settled to the satisfaction of our client.

Mediation of a dispute between two parties that owned a nursing home, retirement village and development sites valued in excess of c. €5,000,000. Likewise we achieved a successful outcome for our client.

Energy Solicitors

Defended High Court injunction proceedings and subsequent litigation in relation to a c. €50 million wind farm and an agreement to use an easement over lands which had a connector cable running over it to the electricity grid. Won denial of the preliminary injunctive relief sought by plaintiffs. Successfully saved client c. €2 million.

Business to Business Solicitors

Action against an international hotel chain in respect of a c. €2 million contract to supply furniture. Our client was successful in recouping 100% of sums due and owing to them.

We acted for a commercial vehicle leasing company defending an interim injunction in the High Court in Dublin. The action was brought by a competitor over the sale of two machines worth in excess of c. €500,000.  

Acted for a client in a fraud case. It involved a deceit and negligent misstatement claim. Our client won the case after a 6 week hearing in the High Court. Our client won again on appeal in which the damages were paid by one of the main Irish banks who were a party to the action.

Trust Solicitors & Off-shore Solicitors

We prosecuted an action for a client against an offshore trust with assets of c. €30 million. Our client sought to regain control of their trust assets. First case in Irish Courts to look through a trust on the basis of family law. In conclusion, the case successfully settled for our client.

Logistics and Transport

Representing one of Ireland’s largest logistics company based in Dublin at the Employment Appeals Tribunal in Dublin. Principally, the case involved an employee taking an unfair dismissals action. Successfully settled before the hearing.

Redundancy Solicitors

Representing c. 20 employees in Dublin in relation to a redundancy in respect of a foreign media company. The company was closing its operations in Ireland. However, following proceedings in front of a Rights Commissioner and the Labour Court, we successfully negotiated a settlement. 

Retail Solicitors & Leisure Solicitors

Representing major fast food group in Cork in relation to a constructive dismissals case and settling same at mediation pre-trial.

Technology Solicitors

We acted for a foreign client in the defence and counterclaim of a multi-million euro computer product distribution agreement dispute. The key issues in dispute related to anti-competitive behaviour and breach of contract. 

Pharmaceutical Law 

Defending a client in relation to a shareholder dispute and injunction. Interestingly, the dispute involved a c. €10 million pharmaceutical company. However, we successfully negotiated an exit for a shareholder.

Defending clients in relation to an application by the Director of Corporate Enforcement. The cases involved striking directors of pharmaceutical companies off the companies register.

Insolvency Solicitors

Defending a receiver client in relation in a multi-million euro anti-competition claim against Irish cement companies. However, we successfully defended the receiver from any personal liability.

Landlord Solicitors, Tenant Solicitors and Commercial Lease Solicitors

Finally, we defended a dispute for a client in respect of a rent review for a commercial premises in Dublin. Our client took ejectment proceedings against a tenant in the High Court in Dublin. Also, a further dispute arose in relation to dilapidations and in relation rent. In addition, there was a dispute in relation to a hotel development and an agreement for lease.
